Rent

(Querist) 26 September 2010 This query is : Resolved 
Dear Sirs/Madam,
My mother along with my younger brother was owing one property of which one shop was alloted to a person. He is not paying rent since 2003. PREVIOUSLY HE PAID RENT TO MY MOTHER WHO HAS EXPIRED. AFTER HER EXPIRY THE PROPERTY OWNED BY HER HAS BEEN TRANSFERED IN MY NAME BY VIRTUE OF HER WILL AND NOW I AM PAYING THE TAX OF THE PROPERTY IN QUESTION. NOW WHEN I ASKED THE TANENT OF THE SHOP TO PAY THE RENT OF THE SHOP HE IS NOT PAYING. I SENT HIM MANY REMINDERS TO PAY THE RENT IN WRITING ALONG WITH PROOF OF MY LANDLORDSHIP HE IS NOT REPLYING. HE TAKES THE REGISTERED LETTERS BUT NEVER REPLIES. WHAT SHOULD I DO KINDLY ADVISE.

Do not wait anymore. File proceedings before the rent controller for his eviction on the ground of wilful default in payment of rents.

I would like to add one more aspect, seek the eviction of the tenant from the shop on an additional ground of personal necessity also.

such kind of tenants will always create trouble...meet some local lawyer in order to find legal position in this regard.

But be sure you have record of rent reciepts , since on this count alone a landlord is protected otherwise all rent acts are in favor of tenants.
