You have confused yourself with the provisions.

The penal provision is section 138 of Negotiable Instrument Act.

The Procedural provision under which private complaint filed is section 200 of Cr.P.C

Non-mentioning section 141 of N.I. act in the complaint is not fatal and when the accused is a company sec.141 of N.I. Act is deemed to be present.

Your lawyer has done a right thing.

Don't suspect your lawyer without understanding the provisions and procedure
