respected sir, our (ssi) comapany suppiled goods worth around 10 lakhs to a government concern. but till date they didnt paid. what are the procedures to get the money or to file a case against them ? is there any special body acting in india for delayed payment? please help us ?

It is better to check with the order form/contract to see if there is any arbitration clause. If no such mode is prescribed, you need to go to a civil court. In any case, it is advisable to issue a notice demanding payment. Your lawyer will be the right person to guide you through the process.

I agree with Bharat. Notice to be issued u/s 80 of the CPC to the Deputy Commissioner, who is the agent of the State and to the head of the department giving them 60 days time to make the payment. If you failed to follow sec 80 your suit if filed, will be dismissed.

It is not understood is what sort of government concern U have referred to. If it is a Co. having its registered office in the State, U may proceed to wind up the Co. In all probability, U will recover your dues. If it is not a Co., proceed as already advised by my Ld. brothers. Check the provisions of Interest on Delayed Payment to Small Industries Act.
