22 persons were arrested under section 452 and section 3 of pdpp act and the JMFC court. the bailor moved the bail petition without aid of advocate and the arrested persons were also released bail same day. so i wanted to know that whether a bail can be given without the presence of an Advocate and without appointing PP for hearing of the nail petition.

Any person can defend his own case with the permission of the court and it is not the requirement of availing the services of an advocate. So far as role of PP is concerned, it is not the complainant or the accused, who appoints him rather they are appointed by State Govt for each and every court who deal all cases pertaining to State.

Yes without the assistance of an advocate bail application can be filed. Advocate help is not necessary.

It is a matter between the accused,court and the police. PP is acting merely as the mouthpiece of police.Therefore if the police appear directly and submit there objections to the bail the court can decide on it even in the absence of the PP. the presence of an advocate for accused and the PP are absolutely unnecessary if the court is provided with sufficient details.
