State and Subordinate Services Rules

X was appointed as office Assistant in the Judiciary department and the employment was sponsored by the Employment Exchange.

It was on temporary basis under State and Subordinate Services Rules.

Since X was absent for a day with out prior information, was terminated from service.

No department proceedings were conducted.

What is the remedy for X ?

Termination may be as per state service rule for the persons appointed from Employment Exchange.If the termination is against the rule X can challenge.

No service rule can be framed against natural justice and it demands that no person should be condemned unheard. Here the employment of an employee has been snatched without even calling reason for his absence. This termination is entirely against rules hence it requires immediate challenge before High Court and try to get stay against execution of the impugned order, if no charge has been handed over during this period.

Temporary service can be terminated at any time & there is no need to conduct departmental proceedings.
