It depends upon the facts of the case as well as due permission obtained by complainant from the competent officers of the State.

Delay can be condoned. If the nature of offense is not connected to this employment, you need not get permission from the superiors.

Suppose you are initiating cheque bounce case, you need not get the permission from the superiors.
