right to property

father has a property in his name inherited from his father. He is not keen to write a will. He has two sons and one grandson from elder son only.
Pls advise who gets the claim for hos property after father's demise

You and your elder brother get the equal share of the property after demise of your father,if your father die intestate.

If the father dies intestate the two sons will get equal share, the grand son will get share from his father's share.
