Approach the bench.

Querist : Anonymous (Querist) 12 March 2011 This query is : Resolved
As a programme i see on every saturday on T.V. in which i see that the place were a crime has been committed the defence advocate & the opposite advocate goes for the investigation without the police permission who is the incharge of that particular case or without the permission of the court it is valid or not ?

Can defence advocate or any other advocate who is assocaite with the case can visit the place whether sealed or not & if sealed than can remove the seal & take the survey or do the investigaton without the permission of the court or police officer who is the incharge of that particular case ?

Also in that serial the defence advocate or the opposite advocate says that can i approach the bench give me more time to find the evidence in the case can we say it is right that by saying that can i approach the bench & then the judge says yes the permission is granted for more 1 or days . ?

Thanks

God Bless.....

Well,it depends upon facts and circumstances of case and investigation. If there is a doubt on Investigaing Officer's investigation, then The Defence Lawyer can do things as asked by you even without prior permission of Court.

It could be a drama not a real story.
