Dear Experts,
I need your advice regarding the problem mentioned below:
I have 1/4 th share in an undivided property (located in Kolkata) which is yet to be partitioned by law. The property is physically partitioned in terms of good faith in between the co-sharers. But unfortunately, the shares are not registered.
I want ONLY my share to be registered without involving the co-sharers - so that in future I can sell my portion or my legal heirs can sell this portion if they want.
Pls note, I am already 60yrs and donot want to invest lot of money for this share.
Regards.

if you want to sell your share you must register, if the other co-shares give any rebut to sell your share, then only raise the problem, other wise no issues, same time the buyer ready to unregister shares ,safety way is register your shares

Thanks for your reply. I am very much willing to register my share(ONLY MY SHARE). As I mentioned in my Query - the property is yet to be partitioned by law & the co-sharers are not interested in getting the partition deed. Hence, If I have to register ONLY my share without disturbing/involving the co-sharers then how to proceed.
Regards.

Dear Mr. Anonymous,
Unless the property is partitioned, the question of registering only your portion (which in any case is not even determined) does not at all arise.
If you want the partition, then you have to file a suit for partition.
Either your age, or your unwillingness to spend money on this issue will not resolve the issue. If you really want the issue to be resolved, then you have to spend money, file a suit for partition and proceed.

Your property is undivided or without partition. So before registering your share first you have to demarcate your share which can only be done either by mutual deed of partition or by decree of court in a suit for partition.
Since you are from Kolkata, if you could mention the area then appropriate court or Registration Office could be referred for expeditious relief.
