applicability of maharashtra rent control act against Govt. tenant.

I want to file suit for eviction and recovery of possesion aginst my tenant which is govt of india. I have follwing queries
1. maharashtra rent control act 1999 is applicable or not in view of bar under sec. 3 of mah.rent control act.
2. which court having jurisdiction to try the case. Kindly advice.

Mah. Rent Control Act applies to the premises let out to Government. Suit has to be filed in the court of Civil Judge Junior Division or Small Causes Court as the case may be depending upon the location of the property
