will i have to pay maintenance to her as the sons are with me and under my care?

if she will go for maintenance or other relief she must prove it, that you have in your name in property, same time you must give either permenant alimony or monthly to her, in case if working in any where you must prove and avoid maintenance.

thanks, u mean permanent alimony or monthly if the property is in my name only right? secondly i am taking care of children myself now.

if you take care of child no need to give for him to maitenance, but she is not go job you will give.

I was told if the wife is educated and working no need to pay and if i get custody of child then no need to pay any maintenance.

Merely because the wife is educated that will not absolve you from payment of maintenance. But if the wife is earning sufficiently, then you may not be liable to pay maintenance to her. Since you are already maintaining your children, there is no question of payment for their maintenance separately. Wife cannot demand any share in the property so long as you are alive.

ALIMONY IS PAID AS ONE TIME LIFE MAINTENANCE
ON DIVORCE,WHILE MAINTENANCE IS PAID AS MONTHLY ALLOWANCE WHICH IS AWARDED WHEN WIFE IS ABLE TO PROOF THAT SHE IS UNABLE TO MAINTAIN HERSELF WITHIN RESOURCES OF HER OWN.
BUT IT IS DUTY OF WIFE TO LIVE WITH HUSBAND,AND IF SHE HAS LEFT HUSBAND ADOBE WITHOUT A REASONABLE CAUSE YOU MAY SETUP BEFORE COURT THAT SHE IS NOT ENTITLED TO ANY MAINTENANCE FROM YOU.
