Limitation on Misconduct/violation

Dear Ld Memebers,

i have filed RTI on dowry Declaration about all the employess of my 498aFIL Office

1) i got reply that 498aFIL retired and the PIO in his reply stated that we could not take any action for not filing dowry also for given/abetted dowry.
note:but given/abetted dowry in service.

2) About other employees they have decalred in white paper without any format[Anex - I & II] as if i'm the govt.

Que'n:
PIO's stand in his replies[1 & 2] are correct?

If not give any better ways of filing RTI or any suggestions

1) PIO's stand is correct. You can seek information through RTI, but cannot ask for any disciplinary action through RTI application. Moreover, the PIO cannot act as a disciplinary authority even for a serving employee, what to say of a retired employee. If you have some definite charge against FIL and he has not retired earlier than a specified period of incident after retirement, you could have approached the concerned disciplinary authority.

2) If you have not asked the requisite information in some specific format only then you can expect information in that format, otherwise in simple form of information as deemed fit by the concerned office.
