Judicial seperation/divorce

Querist : Anonymous (Querist) 28 August 2011 This query is : Resolved
sirs,
please let me know the difference between judicial separation and divorce. After getting a judicial separation order from the court can this be reversed at a later stage or not. similarly can the divorce also be reversed if & when at a later stage both the husband and wife are willing to live together legally. if yes how to go about it.
Kiran Kumar (Expert) 28 August 2011
Read Section 10 and Section 13 of the Hindu Marriage Act, 1955

JS is a reversible process but Divorce is an irreversible process...if the Divorce is granted and thereafter the couple decides for reunion then they will have to marry again.

THE MATRIMONIAL LAW PROVIDES REMEDY. IF YOU UNSATISFIED YOU CAN AGAIN REVERSE THE PROCESS BY YOUR ACT.

i share the opinion expressed by BOTH Experts.

Mr. Kiran has advised you correctly.
In a case of judicial separation, the husband-wife relationship does not come to an end. As such, the relationship can be revived at any point of time.

In the case of divorce, the husband-wife relationship gets snapped. If the parties want to once again become husband and wife, then they have to enter into marriage again.
