Property no using more than 6 months

i am land lord in mumbai ,my PAGDI OWNER is not using property for more than 6 months /have filed a case in small cause court mumbai and if i appoint a local commission through court to see that he has'nt been using the said premises the commission will then set up fixed time and date that he would be coming so pagdi owner would be aware and open his shop in the said time and date what should i do should i proceed with the local commission application because case is on board .please guide

You can lead oral as well documentary evidence such as detail of his electricity bills present and past prior to 6 months, cash book comparison, bank accounts present and past etc. etc.

Oral evidence coupled with documentary evidence shall suffice and there is no need to get the appointment of LC, if you anticipate complete manipulation by him.

In addition to valuable advise of Mr.Makkad ,you can take video graphs date and time wise on different intervals,quite possible now a days,which may create a corroborative evidence to oral evidence.
