In case you are workman, you can file application under Section 33-C(2) of the Industrial Disputes Act otherwise you have to file Civil Suit.

It shall be wise if a notice is sent to employer to do the needful to avoid long litigation. If no fruitful results come out of this exercise only then further step to initiate legal action as per your status should be initiated.
