There are rare chances were Magistrate Refuses maintenance. But you can very well try your case. if she is earning more then the husband and many other reasons as such could be used and try to evade maintenance. it all depends upon facts of the case

Of course mr.shailesh.. But am asking generally that why we have to answer without sufficient details. What is the query here, apart from some grounds can magistrate deny maintenance? He didn't state the facts, same time we don't know that WHATS THAT GROUNDS? Thats it.

It is only the grounds mentioned in section 125 crpc under which the Magistrate can refuse maintenance. There is no other grounds available.

yes agreed with Adv. Barman, except those specified 5 grounds, there is no more ground on which the Magistrate can refuse maintenance.
