Respected Sir,
My client started his service career as a peon under executive engineer in a Govt.Organisation,at the time of joining he was submitted all the relevant records including school leaving certificate,so according school certificate his date of birth was mentioned in service book as 19-01-1952,but unfortunately he was retired from his service according to the decisions of medical board, prior to date of his actual date of birth .whether he will return get back his job or will he compensated ?
please refer to the attachment.

Decision of the Medical Board, as against the School Leaving Certificate, would have more weight unless the original Birth Certificate is produced, as might have been issued by the concerned Municipality.

you may challenge the retirement but need to prove the actual DOB with some cogent evidence....medical board evidence is not an absolute evidence...if you can prove the DOB with some records from Municipality then it will serve your purpose.
