If no FIR is registered, the question of granting AB does not arise, however, a notice in case of arrest may be ordered even if AB is filed.

If you have apprehension so strong that police may arrest you , You can apply for AB, and it should be allowed.
Majority of Judges demand FIR, or lodging of cog cr complaint.
