379/411 i.p.c for mobile theft around rs 1000/-.

sir,
i had submitted a school certificate of class 6th and also gave the oral evidences of parents claiming for juvenile declarartion,both supported the age of the accused as 14 years..but the magistrate ordered for medical board report and the report has come which shows the age of accused as 23-24 years.now , what to do both are contradictory.actully my client didnt tell me the truth and i took the plea of juvenile in the beginning itselfshould i plead to the court for bail as the accused is in jail for more then one month and he is accused for mobile theft which costs around RS 1000/-..

Try for compromise with the party,and surrender in the case that may work positively for the client.

court should be admit the documentary evidence if any.. i.e: birth certificate, t.c etc..

unless documentary evidence is avail then only court can consider the medical report for confirm the age of the accused.

SUPREME COURT OF INDIA:

Juvenile Justice (Care and Protection of Children) Act, 2000, Section 53, 54 - Juvenile - Proof of age - Birth certificate or matriculation certificate not available - In absence of these certificates Board is required to obtain the opinion of a duly constituted Medical Board - However, opinion per se is not a conclusive proof of age - An opinion is not conclusive proof of age.
