Desreted wife -course of action to be taken

(Querist) 03 February 2012 This query is : Resolved 
Sir, an individual X had deserted his wife Y since two months, Both were married legally a year back in Feb 2011 and are issueless. Both are teachers X being permanent teacher drawing 25,000/-and y on contract drawing 8,000/-only.

X also has bad habits of smoking & drinking which was known later on. Earlier for few months both x & y were staying jointly at common working town but since last 3 months later X has deserted Y and is staying with his parents at another place 40 kms away; Y is staying alone. X is not taking any responsibility of Y nor responding to his calls

What should be the course of action for Y
in above situation to bring X on line for his liabilities & responsibilities under law

What does Y want?
If she want retribution then she can file case for maintenance and other protections under section 125 crpc and PWDV Act.

If wife want her husband back then involve the senior members in the family and go for talk for amicable settlement.
Else filing suit for restitution of conjugal rights is the only remedy.

send letters/emails to X requesting him to come back .

if no response involve elders in your family .

if he refuses file an application under DV act for maintenance, right to stay in shared household etc .

if your husband smokes and ddrinks within moderation do not nag him . it is a recipe for disaster .

if everything else fails then file for RCR

As the aim of the Y is just to bring X online and remain in married relations so instead of doing/taking harshful steps, she should firs of take help of family relatives so that matter may be amicably settled in the interest of both parties failing which you may file RCR.

Y should try to resolve amicably by intervention of common relatives to both families,failing which several actions are possible as already told.
