Ownership of two flats in two different cghs in delhi

(Querist) 16 February 2012 This query is : Resolved
Sir,
I would like to know whether there is any law that prohibits a person from purchasing two flats in different co-operative housing societies in Delhi. Both these flats are freehold and have been acquired in resale. Also, can a person become member of two different CGHS on buying flats in resale on both these CGHS ?

The main conditions of enrolment of a member in a Cooperative Society is that an resident of Delhi can become a member of the society if he or she fulfils the conditions laid down in registered bye-laws of different types of societies. The person can become member in an industrial or a transport society if he or she is actually engaged in those respective field and he or she should not be member of other society of similar activities. But in case of housing societies, an applicant for membership should not have any plot/ flat in their name or in the name of any dependent member of their family. But this disqualification is not applicable in the case of person who has acquired property or power of attorney or agreement to sale or on conversion of the property from lease hold to free hold on execution of conveyance deed for it. He should also be resident of Delhi for a minimum period of 3 years on the date of Application. For any other info. you may visit to Office of the Registrar Co-operative Societies) Govt. of National Capital Territory of Delhi, Parliament Street, New Delhi-110001

Dear Mr Sethi,

Thanks for your reply. Does that mean that while a person can not become MEMBER of two CGHS in Delhi, there is no bar to his becoming owner of two freehld flats in different CGHS in Delhi ?
I am asking this because a lot of people who own freehold flats in CGHS acquired in resale and not by way of allotment are not members of CGHS. So as such I can be owner of two flats in different CGHS but become a member of only one CGHS. Will this be in order ?

Request you to clarify.

he cannot be a member of 2 cooperative societies in delhi .

society will not transfer flat in his name .

Vivek Kapoor (Querist) 16 February 2012
Dear Mr. Sethi,

My question is - Can I be member of only one CGHS but owner of two flats in different CHGS ? Because membership of society and ownership of freehold flat are not linked.
