sir,
By living in a village in Jammu and Kashmir from last more than 120 years. Can a family claim that he has a legitimate right over the land for construction of mosque or burrial of dead bodies? when that family has no legal background in this village. The only back ground is that they are settled here as aforementioned and getting residence certificates from the same village issued by the Government of J&K and Government of India.
The villagers are refusing our Burial of dead bodies and denying our stake.If we will approach to court,What should be our legal stand and Does law gives us any hope to claim the share of land.

For burial of dead bodies and construction of mosque in Jammu and Kashmir, no need to prove your residential status. Any body can construct mosque or burial yard with the permission of District Magistrate in the state of Jammu and Kashmir and execute a deed of waqf in favor of Waqf Board.
