(Querist) 13 March 2012 This query is : Resolved 
Dear Sir,

Mr. A & Mr. B stay in the one Mahada Room (In the chawl). Both are Brother. Property in the name of Mr. A.

Mr. A & his family (Wife, Sons & Daughters ) are married & well settled. Mr. A's Sons are settled elsewhere. Mr. A is Died & his wife stay with sons now. Now Mr. A & his family doesn't stay in the above Mahada Room.

On the Other Hand

Mr. B & his family ( Wife, sons & Daughters ) are married but continue to stay in the above Mahada Room.

Mr A's wife & Mr. B both pay 50:50 Rent together to mahada. Both Mr. A & B have their separate Electric connection in the said room & pay their respective dues. Both of them stay in the above room since last 40 years together.

NOW QUESTION IS

1. Since Mr. A is no more, then property will get transfer to whom name. Is Mr. B has any right or put his name in the property.

2. If property goes to redevelopment, then what is the stand for Mr. B in the above case.

3. Is Mr. B or his family have any right on the property,

4. What is the best option for settlement between Mr. A's family and Mr. B & his family.

5. What if Mr. A's family member not ready to pay Mr. B.

Please let me know, what are other consequence & solution are their.

AS PROPERTY IS NAME OF 'A' IT WOULD STAND DEVOLVED UPON HIS HEIRS,SONS,DAUGHTERS AND WIDOW.
'B' OR HIS HEIRS CAN NOT CLAIM TITLE BUT DUE TO PHYSICAL POSSESSION HAVE A BARGAINING POSITION IN MATTERS OF RE DEVELOPMENT ETC.
