Live-in relationship

if a bf and gf stay together on weekend at one place for long that belief they will marry latter.
when boy refuse to marry ?

is that gf claim for 493/376 or this relationship could be called live-in relationship?
if this situation is live-in relationship what rights claim by the gf in live-in relationship?

1. This is not a live-in relationship.

2. If both stayed with Mutual Consent and had sexual intercourse with Mutual Consent, where is the ground for 493/ 376?

3. Let go of the feelings of Vendetta/ Vengeance and lead life normally, the relationship is dead, let it rest in peace.

Dear Rakhiraj,

Your query is inethical,ignoring the moral values.If she goes for 376 crpc,You can count your days of happiness.
Kindly go through the section below:


376. No appeal in petty cases.

Notwithstanding anything contained in section 374, there shall be no appeal by a convicted person in any of the following cases, namely:-

(a) Where a High Court passes only a sentence of imprisonment for a term not exceeding six months or of fine not exceeding one thousand rupees, or of both such imprisonment and fine;

(b) Where a Court of Session or a Metropolitan Magistrate passes only a sentence of imprisonment for a term not exceeding three months or of fine not exceeding two hundred rupees, or of both such imprisonment and fine;

(c) Where a Magistrate of the first class passes only a sentence of fine not exceeding one hundred rupees; or

(d) Where, in a case tried summarily, a Magistrate empowered to act under section 260 passes only a sentence of fine not exceeding two hundred rupees:

Provided that an appeal may be brought against any such sentence if any other punishment is combined with it, hot such sentence shall not be appealable merely on the round-

(i) That the person convicted is ordered to furnish security to keep the peace; or

(ii) That a direction for imprisonment in default of payment of fine is included in the sentence; or

(iii) That more than one sentence of fine is passed in the case, if the total amount of fine is imposed does not exceed the amount hereinbefore specified in respect of the case.

The laws are gender biased all over world. Just follow the story of KANH , he was to a candidate of french Presidency in next election was IMF president. First caught if such live in relationship in STATES and now in a similar cases in FRANCE.

You are just a normal person just try to diffuse the problem amicably other wise there will be endless legal agony.

If the girl goes to Police and files a case that "You had physical relation with her under the false promise of getting married and now after that you are backing out."

And believe me this is not hypothetical !!

Amicably settle and stay away from such friends with benefit loop, morality apart, its not worth the torture if you are stuck legally.

A respectable female may not go to the court with this kind of complaint, but in our society, staying in a hotel without marriage, is also not treated respectfully although it happens quite frequently.
