Respected experts,
I want to know two related issues. 1. What is the legal value of deed of declaration ? Can it be use in place of sale of deed for registration purpose, when buyer and seller are living. 2. What can be done in a case where property was transferred in 1880 but not registered then and now the owner wants to take loan on the property which is not registered in 1880. What instrument of law can be use to register it and how ?

Deed of Declaration and sale deed are two different entities. If buyer and seller are alive make a proper sale deed and duly registered it.

Please suggest on the query completely, what can be done in the case where property taken over in 1880 and no party from the sellers is alive, how can this property can be registered. Thanks

Property taken over is not understood. But as per your facts , you said that no sellers is alive. It means property is in the name of present owner whosoever. Check the property record or take legal search and title of this property by
Advocate. Then only you will understand the title of this property.
