I am in chennai.Water is leaking from my roof
I understand that my upstairs people are using washing machine and letting the water from the machine into toilet .It gets stagnated and starts seeping in the floor and then starts leaking inside my flat.They are tenants and i took up the matter with them as well as the owner of the flat.I am in the ground floor flat. The owner asked them to sort itout with me.The tenants do not agree that the water is coming form their flat.
What to do now?
Owner is asking me to give a police complaint against tenant.
Please advise.

raise issue with society . as per bye laws share of repairs have to be borne equally by you and the owner of flat on first floor

Thanks for the advise but I am sorry that I did not mention that we have no society .This is a housing board flat constructed about 43 years back.Ours is a two storied building having 2 flats in ground floor and 2 in the first floor.
We had a society for about 144 flats but later on we on the outer side of the colony living in the main road have been removed from the membership of the society for the last ten years.About 44 to 48 flats living on the outer side of the colony do not have any society.Now there is a society for those flats living inside the colony.I requested the tenant living in the upstair flat not to use the washing machine for a week so that we can be sure that the leakage is from the flow of the outlet of the washing machine .They are not agreeable and amenable.The owner is asking me to give a police complaint against the tenant .This will lead to further animosity which I want to avoid.Now my ceiling and walls have become dirty and shabby and needs painiting I do not know whether I can claim damages for this .Please advise what course of action I can take.

Its better to get the issue resolved amicably by taking the neighbour in confidence.
Complaining to housing board and taking civil action would take years before the same problem is settled.

IT CANNOT BE FROM WASHING MACHINE, AS NO PART OF WATER DIRECTLY ENTER SLAB OR WALL. IT MUST BE CORRODED WATER LINE , INSIDE THE WALL, THAT MUST BE OOZING WATER, AND NEED TO REPLACE. JOINTLY CHECK IT , ANALYSE AND SOLVE THE PROBLEM. 45 YEARS OLD BUILDING HAVE RUSTED WATER PIPES. [Possibility of tub crack, or joints of tub have hair cracks, that allow water in roof.
