Ld Counsels,
wife claims that more than 15 Lakhs incurred in marriage expenses by her parents and prays the family court for direction to husband for returning the said amount.
Husband wants to get the IT returns of wife and her father which will falsify their claims. Can the family court consider the application husband for production of income details of wife and her parents.

Mr.Prakash,
There is nothing wrong in asking them to furnish the IT returns for the year when the marriage was performed.But most of the expenses are not official and hence not recorded.If they are ready to produce,the court can accept as evidence.

1. The Court can summon her IT records.
2. Follow it up with tax evasion applications with IT dept. to exert pressure.

Though the court can summon IT Returns, it is better to file a Tax Evasion Petition.
In that manner, the IT Depeartment would also be after them to disclose their source of income.

very difficult for court to order marriage expenses. no one told her to spend unreasonable amt, and u r not liable to pay.

The IT retunr of wief eand her parents do nto prove the entire expenditure that includes various facts o.e. jwellery is most of the time inherited, some part of marital gifts and clothes is purchase by relatives. Some expenditure is by petty service provides etc.

The court has power to summon IT records. But that will not contains details of marriage expenses since IT returns are filed without any annexation from 2006-07 onwards.
