one of our regular client gives us the papers to make the service tax returnbefore due date by courier. but due to lack of information they provided later on we filled the return we raised the bill and payment was recived aftter one and half year after relvant dept imposed penalty on that very client for late filling of return they demanded that penalty from us that this was our fault
but this was the mistake by our client not provinding information on time

Service tax or penlty is the liability of the trader.

For lack of service on your part, your client would have to prove in the consumer forum, if he likes to file a case against you.

You acted on behalf of your client as and when he supplied information, since u have received information by Currier, being gentle professional u may prove information received late. In this matter u don't have fault, it is your client's baby he must face consequences
