sir,I am primary teacher in nagar prishad .and our nagar parishad school receive all Aid from state government via Zila prishad.in Zila prishad the rule apply for obsorbtion of surplus teacher (according to the G.R senior teacher should be transfer).there is no rule for transfer of surplus teacher from nagar parishad to another Muncipality school.so nagar prishad adopted the rule last comme first go,in transefer matter which fully againt the G.R. rule apply in Z.P .I attached Nagpur highcourt decision for refering.is it fair that a permanent junior teacher can be transefer if there is other non permanent teacher who are senior are present.please guide me.

It depends If the schools of all Nagar Parishads of a Zila fall within the administrative control of Zila Parishad, the employees of one school can be transferred to another school within the jurisdiction of Zila Parishad.
Since transfer is not a condition of service and is also not dependent upon seniority or permanency, there is no ban on transfer of a senior teacher leaving a non-permanent teacher.
Transfers out of jurisdiction can also be made in the exigency of service.
Transfer can also be made in case of the employee having been involved in some offence to avoid any attempt of manipulation or destruction of records of vital evidence by the employee.
