Not getting divorce since 4 years

Hello, I am from Mumbai. Got married in the year 2007 in Surat. I accepted him as my husband inspite of knowing that he was a divorcee and me being a Fresher. Since the first day of marriage, i was being tortured by my in-laws for dowry. Later-on in the span of 3 months i realised that my husband has an extra marital affair with a Model. Since that day my life went for a toss. He used to come late to home at times not even turned up to home saying he is going out of surat for his business. H8is parents never wanted him to bring a model as his wife at home so got hime married to me. His parents used to support him for keeping this extra marital affair. In that 3rd very month i got to know that i am pregnant. Thought things will change now after having a child in our life. But things became worst.
July 2008 i got a baby boy. On child's 18th day, there was a huge fight at his place because of which he threw my 18 day old son on the bed snatching him from my hand. My mother called police and i was set free from his house with my kid on his 22nd day.
Please help to get divorse...

you have been staying separate for 3 years . you can apply for divorce .
you can also make application under Dbv act and seek maintenance , right to stay in shared household or laternative accomodation

but sir i dont want anything from him as he is a gunda kinda person with all financial and political support..I just want divorse from him and custody of my 4 year old child...He has shown such cruel acts before when i had filed a domestic violence against him but then i had to withdraw as he had hitted my mamaji so badly sending 6-7 gundas and made him bed ridden for 6-8 mths. Pls help. Is there any way out to get rid of this person. I just want divorse for which i am fighting since 4 years from Surat court but no solution. Everytime, mth., i have to rush to surat from mumbai for the case dates but no action taken till date..all because of bribing. He bribes each and every lawyer of mine, judges, police, everyone..Pls help, suggest to get out of this mess..Pls.

ok you have already filed for divorce . if your husband dosent want divorce then it would be a long drawn affiar . contested divorce takes time .
you can move the high court in gujrat for expeditious trial . the court cna direct the family court to dispose of the application expeditiously within 6 months time .
or move supreme court for transfer of case to mumbai
