Dear All,
i have a query regarding the missing person. My elder brother went to Amarnath Yatra on 04.07.2012 from Jaipur with his 2 friend.and thier registration date for amarnath yatra was on 06.07.2012 After Amarnath Yatra they decided to go Mata Vaishno Devi so the went there on 08.07.2012 in the morning time my brother called to my Father from Vaishno devi to say that they are on the way to Mata Vaishno devi that was his last call. and as his friend told us that when they were going UP so my brother told them that he's feeling tired so he decided to rest but his friends decide to move on so they went ahead and he sit so their contact disconact in the crowd so after 1-2 hour my brother's friend called on his no. but the mobile was switch off they search him all around but couldn't find out so on 13.07.2012 i went to Jammu and ask to police man to fil FIR but they didn't file they said in missing case only missing report can be written so i file missing report but in KATRA (jammu) the police is the worst i've ever seen. so i went to jaipur our local police station and ask for report because my brother went from jaipur so they also take one copy of Jammu's report but still i don't have any result for my brother's missing report and police man are not doing thir job properly so what legal action i can take. please help me

The Jaipur Police can do nothing as he is not lost from the city of Jaipur.
Get in touch with higher authorities in Jammu regarding your missing person diary.
If that does not yield any result then you have to file petition u/s 156(3) crpc in the court of local Magistrate.

only his friends can tell the whereabouts of your brother since they were with him. lodge a complaint against them in the police station. rest will come out automatically

Hello All,
I wanted to know that in missing persons case can't we ask for FIR because police said that in this case we can only file Missing Report not FIR. so please help me.

He was last seen by his friend at Amarnath Yatra.
So only J& K state will file "Missing Report"
Shri Vasta's idea can be tried out, but at the cost of harassments to friends.

without working on the idea of Mr vatsa his friends will not cooperate. Thereafter even their parents will go to Jammu.
