(Querist) 19 February 2013 This query is : Resolved 
case is at the stage of completion after a year long wait. however still IO examination remains. I need to visit abroad but the lawyer says that my presence is needed for the FS stage (accused examination). Is it feasible to request that the FS stage be taken before the IO examination under special circumstances? Is there any judgment where such provision is allowed?

no .go by your lawyer advice . you may miss out on trips aborad but what is more important is the 498A case . your presence is necessary .

If your visit for limited period then you can safely visit and come back to face trial. The trial is no hindrance for your foreign visits.

There is no such law as you desire. Your defence statement can be taken only after conclusion of the evidence of the prosecuion.
