Change in 7/12 record.

(Querist) 05 March 2013 This query is : Resolved
Hi,
My GrangPa has 5 Sons and 3 Daughters after his death in 1972 all the property goes on the name of eldest Uncle as "Hindu Undivided Family Manager", in 1980 this uncle was dead and till 2011 all the record was on his name as 'Hindu Undivided Family Manager'. In 2011 successor/son and wife of that uncle submit Purchase Document of Some Land Blocks which was Purchased in 1962 and in 1967 in the name of eldest uncle but actual fact is that after the purchasing of that Land eldest uncle self include this land Block numbers in his 'Hindu Undivided Family Manager' Account because land was purchased by Income of Union Family. But in 2011 Circle officer Split 'Hindu Undivided Family Manager' account only for those 4 Blocks included in Purchase deed and Record those only on the name of Son and wife of Eldest uncle in this way we have no right on this land blocks. Please advice me how can we prove our rights in that land Blocks. From Maharashtra.

You need to prove purchasing the aforesaid properties consideration has moved from the funds of Hindu Undivided family and not from the personal account of your uncle. Merely Karta's name entered in the Record of Rights it does not mean he is the owner of the property. Karta represents Hindu Undivided family that all.

File a suit for declaration before the civil court claiming therein that the HUF at the time of purchase contained you all brothers and after its split the property shall devolve among all brothers and not in the name of the successors of the deceased manager.

What Kind of Documents needed to prove that Purchase deed was by HUF income..?
When he purchased those 4 blocks he kept his separate account rather than Grandpa's account but in 1972 after gradpa's death he prepared One single HUF Manager account containing all Grandpa's land and his land. He included those blocks within his account to HUF because he knew that those R purchased from HUF income. Is it not enough to prove that land blocks are purchased from HUF income?

Going through all stated by you in your posts ,to me, it is sufficient and enough to prove that land blocks are purchased from HUF income.
