Dear sir
I am a Associate professor in medical college.
my son has just passed the final MBBS exam and joined the internship.
on March 3, about 18 students from the medical college, Aurangabad went for dinner at a Dhaba in nearby village.
During dinner, they had a quarrel with a group of villagers taking dinner on next table due to loud sound and shouting.
one of the student phoned the local leader of some party and told him about the incidence.
the leader asked the villagers not to quarrel with these students, I know them.
after dinner, one of the villagers came to these boys and asked them that who called the leader.
then he kicked the chair of one of the students. somebody from students take a bottle from table and hit the head of the villager who kicked. then the dhabawalla came. He along with other customers, controlled the quarrels.
students finished their dinner and started to move. some students left the dhaba like my Son and other 7-8 students. mean time a group of villagers came and they started to beat the students. dhabewalla called the police. students called some other students from medical college. but when other students came for rescue, police had arrived and arrested 10 students and 4 villagers. rest of the students managed to run away from the scene.
police booked these students and charged with crpc 307 and next day got the 3 days PCR. 5 among 10 were hospitalised and 4 villagers also hospitalised.
when I know the incidence, I called my son to my place.
after 3 days students got MCR and on next day released on bail.
Now, my problem is that during PCR, the students told 16 oyher students name who were directly or indirectly present at the scene. my son is also among these students.
Now, wheather I will apply for interim bail or anticipatory bail?

If you apprehend arrest apply for anticipatory bail.

Since your son is not named in the FIR I do not think he runs imminent risk of arrest.

Dear Querist
your son name comes in light on based of dis closer by others, no need to worry file AB first and get all the documents as FIR/Complaint, medical report, MLC.

Generally if an unnamed person/accused in FIR applies for anticipatory bail then he himself invites his entanglement in that case. Police presumes that this person might have been involved in the crime so he may be shown involved.
Better not to go for AB as your son is not named.
