Property division

(Querist) 05 April 2013 This query is : Resolved 
My Grand Father married with 2 woman
1} when my Father birth my Grand mother DED
2} so that's wy my Grand Father have second marrieg
3} with second woman my grand father have 2 child 1 girl and 1 boy
4} My Grand Father ded in 1980 and my second grand mother ded in 2006 my Father ded in 1993
5} my anti married in 1988 (1 girl) and he has no child
6} my uncal (1 boy) have 2 child (girl),iam only one child of my father (boy)

Q1] how meny apply the name for the property

Q2] when we division of property how much part i got

Q3] is it right my ant got 1/3 part (but his marrig date is 1988)

I have cam to across with the provision from Hindu Law that if the maregis taken before 1993 then property of prantes

can u plies pro light on this
and its applicability on above menshen

1. The property first of all shall be divided among the legal heirs of your grand father viz. your grand mother, your father, his step brother and step sister in equal shares. This means your father shall be entitled for 1/4 share as on 1980 when your grand father expired.

Now come to year 1993 when your father expired. His estate shall further be divided in 2 equal shares among you and your mother and shall not to to your step grand mother. Had your real grand mother alive, the equal share out of the estate of your share might have gone to her. It means you became owner of that property which was left by your grand father to the extent of 1/4 share with your mother.

There shall not be any effect of the expiry of your step grand mother over your share.

This entire discussion is based on the presumption that your grand father was having his self acquired property in hand.

Yes!
Mr.Makkad is right as Your branch share is 1/4 together with your mother(1/8 each).

Your aunt's share is her own 1/4 + 1/8 of her mother's 1/4 and she will get all as she has no child.

Your uncle's branch share is also 1/4 +1/8 of his mother,but you say he has 2 daughters then if these daughters were born in the life time of your or say their grandfather then and only then they would take 1/3 of 1/4=1/12 each while your uncle would get 1/12 + 1/8 from her mother's 1/4.
