Writ should be filed before the h.c or should file before the sc?

Due to rise of 498-a/406 cases, many NGOS/ Forums has made good draft by analysis of the judgments, Collection of data through RTI from NCRB, Collection of media reports, analysis made by International communities..They have put suggestions before the Govt to amend the laws by making 498-A AS Bailable, non cognisable and compoundable
Sushsil kumar case, pratibha kumari case etc The Hon'ble SC too has label it as legal terrorism and made suggestion to made it bailable..
But equally no directions has been used in the absence of making Govt as party..If the litigant is encouraged to file the case in the public interest by arraying Govt Union of India as party
Whether one should approach to the H.C or should approach to the SC by filing the writ petition?

Since it touches issues involving fundamental rights of the citizens, you better approach supreme court fr adequate reliefs.
