My father was expired without any will.One construted house acuired by him , it was on his name now which was given to rent.We are two brothers, my brother is not interested to divide the house.His inteniton was try to own the whole house.
I am having three chidrens(one major and other two are 17 years). My question is that my childrens go to court for dividing the property. plz help me

If the property owned by your father was his self-acquired property, then it will go by way of inheritance equally between you and your brother. Your children have no role to play.
When your brother himself is interested in dividing the property (house) where is the need for your children to go to court for dividing the property?
I think you are not coming out very clear on your facts and also on your query.

Your children do not have any right to claim any share in the property till you are alive. Of course, if desired, you can claim your due share legally.
