Gentlemen this query is on behalf of my close friend as she can not communicate in English.
She is owner of a flat in a registered coop society in Mumbai. She is not admitted as a member on the pretext that her sale deed is not registered due to absconding builder and arrogant members of managing committee although full stamp duty is paid.
Since last 3 months or so there is a heavy seepage in the ceiling from the flat above her flat. In spite of the fact that she is promptly paying the monthly dues and have lodged complaint with the society as well as BMC but there is no response.
Pl. help and advice as what she should do in this matter as she is worried a lot about her property ?

Builder is absconding. Sale deed not registered. Just payment of stamp duty does not pass ownership. She has very weak rights.

she is in possession of flat and she has all the legal rights to stop the nuisance of seepage against owner of flat.

Ask the concerned flat owner for repairing.
If no response, send notice in writing to flat owner and the society, BMC.
