As we know, now a days in modern banking, ATM withdrawlas are common.
Here is a case, where A pensioner who died on natural death; one of the son of the Central Govt. pensioner draw the pension after the death;
What is the consequence and legal implications for the money drawn after the death of the pensioner.

Also tell me how can we prove the person who draws the money; since it is drawn from the ATM; where proof of withdrawal is not available or be proved.
If it is s a criminal offence, who will be punished? (the drawer is un identifiable, since it is drawn from ATM)

ATMs have security cameras which record presence at ATM for cash with drawal . the data is stored for more than 14 days . in the vent of any complaint police /bank will scan the records to find who has made with drawals at the given date and time .
the person who made the withdrawals would be punished

his family members will tell who used to hold the ATM. He will reveal the facts in remand and also lead police to recovery of cash.

The son has to pay back all pension. Legal action can be bought against him by the bank itself apart from the concerned pension paying authority.

The one who took the money is responsible for penal action. But other sons too have the duty to inform the bank and the pension authority about the demise of the pensioner.
