Co.op.socity's recovery of maintenance charges

Dear sir,
175 members registered society. Provisional committee is ineffective. Builder is recovering maintenance & running society admin.(nearly 2 years)
45 members are not paying maintenance since last 2 years to the builder. Builder is also not taking interest to recover this money.
After handover, can newly elected committee would be able to rover these outstanding s?

yes . MC should issue legal notice to members to pay the outstanding dues with 21%interest . take recovery proceedings under section 101 MCS Act

The newly formed committee can definitely recover the outstanding as it shall be in succession.
