Residential building - rented flats

Dear Sir,
Have following questions:
1) Are guest house allowed in a residential building?
2) For a rented flat in a residential building, occupied by "Bachelors", can there be a "cap" on number of occupants in a 2 and 3 bedroom flats?
3) If there is no law to limit the number, can the society put a cap?

if here is no resolution passed by society prohibiting use of flat as guest house you can do so .
societies are reluctant to permit use of flat as guest house . obtain prior permission of society . reasonable restrictions can be imposed by society

Guest house is commercial activity and not permitted in residential area till specially permitted or rules are specific in this regard.
Society is justified in imposing restrictions on such activities in the society if bye laws does not permit or any resolution is passed.

The action of the society is well within the legal provisions as the guest house cannot be permitted to be run within the premises of the society as the same is a commercial activity.
