Lease shop

(Querist) 04 December 2013 This query is : Resolved 
We have the property in my mother and wife name at Panipat. We give it the same to some person under lease agreement on Rs. 50/- three years back but when the lease is expired after 11 months he dose not come to renew the same. We request him to do it early but nothing is done from his side and now he is stoping/delaying the rent payment and electricity bills. What to do in this matter? Kindly guide.

1.Issue legal notice asking payment of arrears of rent and damages.
2. Determine the lease and declare him tresspasser imposing damages.
3. Move to the court for eviction

At present he would be treated as tenant by default and his tenancy would be treated as tenancy month to month and can be determined
by serving notice of a month under section 106 of Transfer of Property Act and arrears of rent and damages along with vacant possession of leased shop can be demanded and his failure to do so,a small causes suit would be maintainable.

You can easily get back your shop with the entire arrears of the bills and rent with mesne profit but serve notice to the tenant first.
