(Querist) 05 December 2013 This query is : Resolved
sir, I am from Kerala, my husbands is in latin America from past 1 year . For his renewal of visa those country need birth certificate. My husband was born on 1st april 1966. He is holding all his certificates{sslc, degree, election id..etc,etc } in this date. But now to avail birth certificate i went to panchayat, there we were told that birth is registered in different name and date i.e 1st august 1966. So they said they are ready to issue certificate based on their record, which is of no use to us . So now i kindly request u to sugesst me what i can do , how can i get birth certificate based on existing documents,
Can i correct all certificates based on birth certificate issued by panchayat record????
I beg u please help me to find solution for this problem

For renewal of visa the birth certificate as mentioned in the passport only would be required.Your husband should file an affidavit declaring the correct date of birth in the court and court would direct the panchayat to issue the corrected d.o.b. as per passport.Since your husband cannot attend the court now your advocate has to convince the court for accepting the affidavit and declaration in writing by your husband which is attested there,Only your Advocate could help you contact an suitable advocate.

You can file a petition before the Judicial Magistrate court under births and death registration act seeking a direction to instruct the competent authority to register your correct date of birth and issue a birth certificate, the formalities for this can be known from a local lawyer.
