(Querist) 26 December 2013 This query is : Resolved
In MOU the time limit for payment is 2 months whereas in the sale deed it is mentioned as within stipulated time
Can we assume it is for 2 months
ajay sethi (Expert) 26 December 2013
no you cannot draw any assumptions . time period has to be specifically mentioned
V R SHROFF (Expert) 26 December 2013
"as within stipulated time" is meaningless time period..
it must be certain/ specific
Devajyoti Barman (Expert) 26 December 2013
No, you can not. Now it is open to both the parties to interpret time. In other words there is time constraint in sale deed.
Rajendra K Goyal (Expert) 26 December 2013
Agree with the experts, it can not be interpreted as 2 months unless mentioned specifically.
T. Kalaiselvan, Advocate (Expert) 27 December 2013
The stipulated time as per the limitations act is three years from the date of agreement if there is no mention about a particular time limit period.
R.V.RAO (Expert) 16 February 2014
