Yes it is under the new amended Cr.PC.

Yes it is still compoundable because, In notification of enforcement of amendment Act 2005.
The Section in which 320 was Cr.P.C was amended has been excluded. Thus still it is compoundable.

I entered into an agreement to sell with B and received earnest money of Rs one lac and later on compromised was effected orally and I gave him a cheque of Rs two lacs ie one lac for refund of earnenst money and one lacs as damages and also agreed that in case, the cheque is bounced B can file criminal complaint unde section 138 as well as , he can also file a suit specific performance of the agreement to sell for the purpose of registration of sale deed.
My query is whether I can be held liable for both ie under section 138 of nI Act and also to sell my property .

Dear Mr. Satya Nand,
I wonder, if as an advocate you preferred to arrive at an oral compromise in the presence of a written agreement to sell!
However, your doubt is confirmed, as you can be held liable for both, i.e. under section 138 of nI Act for cheque dishonour and also to sell your property, as of specific performance.
