sir,
my marriage was on 7th sep 2013. I choose a lady considering her education and character. after three months only I came to know that she had cheated me on her qualification and character and she is a feminist basically and she hided it on betrothal. she is form a poor family and me from a middle class and I never asked for any dowry. she did all these cheating after studying HM act 1955. when I asked her about this cheating she tried to threaten me by attempting suicide but I could not take any action against her because she was at my house and she is not willing to leave my home and I had to get more evidences. I am an NRI and the evidence with me is only telephone conversation recording and mail. I can never live with her and I have to be get separated. Sir could you please advice me which type of case could I file against her. can I file a divorce case on the grounds of cruelty. Whether the court will consider these documents as evidence.

1) you are not even married for one year . no divorce case be filed until one year has passed after your marriage .
2) being a feminist does not make her character less . no case of cheating is made out .
3) you have not disclosed what suppression has your wife done regarding her educational qualifications ? .
do you have her bio data given at time of marriage mentioning the false qualifications ?

sir,
following my advertisement on a news paper they approached for an alliance. she said that she is having a degree and PG from a reputed college which is affiliated to a recognized university and she repeated the same every time. after the marriage when ever I asked her to show her certificates made some excuses. At last on 26'th Dec she mailed me the certificates and that time only I came to know that it is distance education certificate form a private university which is not recognized by nay Govt. That time also she was firm on her stand and the next four days I asked her repeatedly to disclose the truth but she was not willing. On 31 I asked her to go her home and she can come back only after my discussion with her parents and she agreed that.
But the very next day early morning she attempted suicide by cutting her hand. she explained for it that she was trying to skip out from my life and she threatened me to commit suicide by her and her mother. Now she admitted that she is having only non valid distance degree and PG and she was lying and is begging to be excused and now also she is saying that the court will never grand me divorce based on these. I am an NRI and dealing with medicines and she tortured me to the last extent and in future if there is an adultery also her stand must be like this and I lost trust over her.

i feel you hidden some points. for divorce you need to wait some more time, more over you are NRI too ,The university is pvt and not recognized by UGC is not her mistake, in this point she is not cheated, so try to remove the problem by way of talk ans solve. and try to lead the happy life

You have to wait for some time for divorce. The grounds may not fetch desired results. Better try for an amicable solution and save marriage. Life would not be better even after it.
