(Querist) 15 May 2014 This query is : Resolved 
a builder and owner executed an agrremeNT of sale in favour of purchaser in the year 1999 which is an unregistered document the purchaser is in possession of the flat since then inspite Of several attempts the builder did not execute the sale deed now builder is absconding my query is can the purchaser file a suit for specific performance or should he file a suit for declaration though nobody is questioning his title or is there any other way to peerfect his title

IT is time barred. Withing three years you could have sent the notice to the builder and owner to execute the sale deed.

what were you doing for 15 years ? you should have filed suit for specific performance if builder did not execute sale deed .
