What about the appeal against the termination order by the company?, was it challenged before the next higher authority or through the labor court? Why the present suit has been kept pending ever since the date of his termination?, more and proper information may be posted.

Alright, since you have directly approached the high court for relief, you may follow up the case in accordance. The suit seems to be filed during the year 2005, whereas the company appears to have terminated the services during the year 2006, this proves that the company provoked over the legal case against it, as a retaliation, have terminated the services, so it is established that it is an after thought action to avenge the employee. This may also be brought to the notice of the honorable court and citations to this effect may be produced to challenge their defence. What is the present status of the case?
