One flat converted into two is legal?

(Querist) 07 July 2014 This query is : Resolved 
a flat in society In mumbai

share certificate issued in single name
electric bill in tow names flat name
agreement made with builder is of one flat

now teh member want to convert teh same into two and wants to sell one flat from it.

is it legal please let me know. thanks in advance

even if teh BMC approved plan shows 2 flat then also if it is possible,
whether society can issue sh certificate for teh same if it is yes to convert one into two.

however in teh said flat which tehmember wants to convet into two flats..
there is a water two bills coming from BMC bearing continueous bill no 05 and 06.

why does it come twice for single flat

Well advised by the expert V R SHROFF ji, the two bills from BMC does not authorize the conversion.

agree with Mr shroff . society will not permit such a conversion . no NOc will be issued by society in such a case

The act is totally against settled rules meant for the societies hence no such permission can be granted.
