Whether relief arising out of the disposal order in a W P before the single bench High Court are enforceable when the other party ( respondent ) to the WP has preferred appeal before the division bench against the disposal order where the appeal is pending for more than three years but the division bench has not stayed the disposal order of the single judge.

If no stay order has been provided then the execution of the single judge order can be made as per the provisions of CPC.

Thank you very much. The relief that was sought in the W P was quashing of the report of Lokayukta, release of DCRG ( Death Cum retirement Gratuity ) and regularization of suspension period. The disposal order passed by the single judge is in my favor.

Also please let me know under which section of CPC execution of the single judge order can be made.
